C. S. Gardner & Associates, Inc., is multi-faceted real estate appraisal and consulting firm. The firm specializes in appraising for litigation valuation, eminent domain, and condemnation proceedings. We do assignments for mortgage lenders and individuals on commercial, industrial, acreage, residential and all property types. We serve lenders and clients in Flagler, St. Johns, Putnam, Duval, Clay and Volusia Counties.
The firm places a strong emphasis on individual owner's property rights. If your property is being acquired by a governmental agency, we work with you to insure that you are justly compensated for your property. The firm also does consultation work involving litigation valuation. Such work includes expert witness testimony, assistance with trial strategy, appraisal review, assistance in mediation, fee and cost analysis, and other consultation services.
The firm accepts assignments throughout the state of Florida. We have also completed assignments for the "United States Department of Interior" on the "Blue Ridge Parkway" in Virginia. We also accept assignments for governmental agencies. In addition to litigation appraisal, the firm accepts valuation assignments involving protection of property owner rights in matters of zoning/land use changes and taxation.
The following ethical rule is taken from the 2008-2009 edition of "Uniform Standards of Professional Appraisal Practice" published by the Appraisal Foundation. It is unethical for an appraiser to accept an assignment, or to have a compensation arrangement for an assignment, that is contingent on any of the following: 1. the reporting of a predetermined result (e.g., opinion of value); 2. a direction in assignment results that favors the cause of the client; 3. the amount of a value opinion; 4. the attainment of a stipulated result; or 5. the occurrence of a subsequent event directly related to the appraiser’s opinions and specific to the assignment’s purpose. (emphasis added) The subsequent event mentioned at No. 5 may be the closing. If an appraiser agrees to wait until the closing to receive their fee they may be in violation of this ethical rule.
